This privacy policy (the “Privacy Policy” or “Policy”) of Cagan Management Group (“Company,” “we,” “us,” or “our”) describes our privacy practices regarding information we collect from persons (“you” or “your”) who visit the marketing websites of the apartment communities we manage (each, the “Site”). This Policy applies to every community website that displays it. Each Site is an informational website for its community. Applications, resident accounts and payments are handled through our RentCafe Resident Portal, which is governed by a separate Privacy Policy available at https://www.rentcafe.com/apartments/privacypolicy.aspx and by the Cagan Management Group Privacy Policy posted on that portal.

Purpose. The purpose of this Privacy Policy is to inform you about the types of information we gather about you when you visit the Site, how we may use that information, whether we disclose that information to anyone, and the choices you have regarding our use of the information. This Policy does not cover information that is exempted from privacy policy notification requirements, including information about employees, contractors, job applicants and information processed exclusively in the context of a business person acting in a business capacity.

Acknowledgment and policy changes. Please read this Privacy Policy carefully. By using the Site you acknowledge that you have read and understood how the Site collects and uses information as described here. The use of analytics cookies is a separate matter: it happens only with your consent, given through the cookie notice displayed on the Site, and you may withdraw that consent at any time as described below.

Company may amend this Privacy Policy from time to time. We will post those changes on the Site and update the Privacy Policy date below.

Personal information collected. For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

The Site does not contain forms, accounts or logins, and does not ask you to submit Personal Information. The Personal Information we may collect in connection with the Site is limited to:

  • Information you choose to provide when you contact a community office directly by telephone or email using the contact details published on the Site, such as your name, telephone number, email address and the content of your inquiry;
  • Technical information recorded automatically by our hosting provider when you visit the Site, including your Internet Protocol (IP) address, browser type, the pages you request and the date and time of your visit; and
  • Usage information collected by Google Analytics, only if you have consented to analytics cookies as described below.

Information you provide when you apply for a residence, schedule a tour, make a payment or use resident services is collected through our RentCafe Resident Portal, Calendly or other third-party services and is governed by their privacy policies and by the Cagan Management Group Privacy Policy, not by this Policy.

Personal Information you provide to a community office by telephone or email is retained for as long as reasonably necessary to respond to your inquiry and to provide leasing and property management services. Retention periods may be extended if we are required to preserve your Personal Information because of litigation, investigations or other similar proceedings, or if a longer retention period is required or permitted by applicable law.

We do not and will not sell your Personal Information.

How we use and share personal information. We use the information described above to respond to your inquiries, to operate, secure and improve the Site, and to understand how visitors use it. We may share information with contracted service providers who host the Site or provide analytics on our behalf; to comply with legal obligations; when we believe in good faith that an applicable law requires it; at the request of governmental authorities or other third parties conducting an investigation; to detect and protect against fraud or any technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety or security of our business, third parties, visitors to the Site, or the public. We may also share Personal Information with any person to whom we transfer any of our rights or obligations under any agreement, or in connection with a sale, merger or consolidation of our business or other transfer of our assets, whether voluntarily or by operation of law, or who is otherwise deemed to be our successor or transferee.

Use of cookies and other technologies. “Cookies” are text files that are placed on your computer or device by a website. The Site uses cookies in a limited way.

When you first visit the Site, a cookie notice asks whether you consent to the use of analytics cookies. The Site places one cookie to remember your answer so that you are not asked again. Google Analytics is not loaded and no Google Analytics cookies are placed until you have consented. Cookies placed by Vimeo when the home page video loads are described under Video below; they are not controlled by the cookie notice.

If you consent, the Site uses Google Analytics, a web analytics service provided by Google LLC (“Google”), to better assist Company in understanding how the Site is used. Google Analytics will place cookies on your computer that generate information about your use of the Site, including your computer’s IP address. That information will be transmitted to and stored by Google and used for the purpose of evaluating consumer use of the Site and compiling reports on Site activity for Company’s use. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. The use of cookies by Google Analytics is covered by Google’s privacy policy: https://www.google.com/policies/privacy/. If you decline, or if you close the notice without answering, Google Analytics is not loaded and no analytics cookies are placed.

You may change your choice at any time by selecting Cookie settings in the footer of any page of the Site. You can also choose to delete existing cookies, allow or block cookies, and set preferences for certain websites in your browser’s settings. The Site remains fully usable if you block cookies.

Video. The Site displays video hosted by third-party providers. Video on the home page is provided by Vimeo, Inc. and loads when the page is displayed. When it loads, Vimeo and its hosting provider place cookies on your device, which may include a Vimeo analytics cookie, whether or not you have consented to analytics cookies through our cookie notice. We load the Vimeo player with its do-not-track setting enabled, but any cookies Vimeo places are set by Vimeo, are outside our control, and are governed by Vimeo’s privacy policy (https://vimeo.com/privacy). You can prevent them by blocking third-party cookies in your browser; the video will still play. Other videos and 3D tours on the Site are provided by Vimeo, YouTube or Matterport and load only when you choose to play them, at which point that provider’s privacy policy applies.

Apart from the Vimeo cookies described above, the Site does not display advertising, does not use advertising or social-media tracking technologies, and does not use marketing or lead attribution services.

Third-party websites. This Privacy Policy applies solely to information collected through the Site. It does not apply to other websites that are accessible through the Site, including without limitation the RentCafe Resident Portal, RentCafe.com, Calendly, Vimeo, YouTube and Matterport, each of which has its own privacy policy. By using RentCafe.com or any property websites or portals powered by RentCafe, you acknowledge you have read and understand the latest version of the RentCafe Privacy Policy posted at https://resources.yardi.com/legal/rentcafe-privacy-policy/.

Your privacy rights. Depending on the state in which you reside, you may have rights under applicable law to request access to the Personal Information we hold about you, to ask that it be corrected or deleted, or to object to certain uses of it, subject to exceptions provided by law. Because the Site itself collects little Personal Information, such requests will generally concern information you have provided to a community office directly or through the RentCafe Resident Portal. To make a request, contact us using one of the methods listed below. We may need to confirm your identity before responding, and if we cannot verify your identity with the degree of certainty required, we will not be able to respond to your request. We will respond to your request within the time required by applicable law, and if we cannot grant a request we will tell you why, as best we can.

Minors. The Site is not directed to persons under the age of 16, and we do not knowingly collect Personal Information from anyone under 16 through the Site. If we learn that a person under 16 has provided Personal Information to us through the Site, we will take reasonable measures to delete it and not use it for any purpose, except where necessary to protect the safety of the minor or others or as required by law. Information about minors that a parent or guardian provides in connection with an application or lease is collected through the RentCafe Resident Portal and is governed by its Privacy Policy. We do not sell the Personal Information of minors.

Do Not Track. “Do Not Track” is a privacy preference that users can set in certain web browsers. We do not respond to browser do not track signals. Your choice regarding analytics cookies is made through the cookie notice on the Site and is honored as you set it.

Accessibility. We are committed to ensuring that our communications are accessible to people with disabilities. To make accessibility-related requests or report barriers, please contact us using one of the methods below.
